1. Scope of Application
For the business relations between BBD Buy Best Europe GmbH and the customer, the following General Terms and Conditions in their version valid at the time of the order shall apply exclusively – also for all future transactions. BBD Buy Best Europe GmbH does not recognize any deviating conditions of the customer, unless BBD Buy Best Europe GmbH has expressly agreed to their validity in writing.
2. Conclusion of Contract and Cancellation
BBD Buy Best Europe GmbH undertakes to accept the customer's order under the conditions of the website. In the event of spelling, printing, and calculation errors on the website, BBD Buy Best Europe GmbH is entitled to rescind the contract. If the supplier of BBD Buy Best Europe GmbH fails to deliver the ordered goods to BBD Buy Best Europe GmbH despite a contractual obligation, BBD Buy Best Europe GmbH is likewise entitled to rescind the contract. In this case, the customer will be informed immediately that the ordered product is not available. The purchase price already paid will be refunded immediately.
3. Delivery
Unless otherwise agreed, delivery shall be made from the warehouse to the delivery address specified by the customer. Information regarding the delivery period is non-binding, unless the delivery date has been bindingly promised as an exception. Please note that we only deliver media and consumer electronics products in quantities typical for a household. Claims for damages are excluded unless there is intent or gross negligence on our part.
4. Right of Withdrawal for Consumers
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.
To exercise your right of withdrawal, you must inform us, BBD Buy Best Europe GmbH, Eiffestrasse 74, 20537 Hamburg, Germany, info@victoria-hyde.com, by means of a clear declaration (e.g., a letter sent by post, fax, or e-mail) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, but it is not mandatory.
You can also fill out and submit the model withdrawal form or any other clear declaration electronically on our website www.victoria-hyde.com. If you make use of this option, we will send you a confirmation of receipt of such a withdrawal immediately (e.g., via e-mail).
To meet the withdrawal deadline, it is sufficient for you to send the notification concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse you for all payments received from you, immediately and no later than fourteen days from the day on which we received the notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this reimbursement. We may refuse reimbursement until we have received the goods back.
You must send back or hand over the goods immediately and in any case no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.
You shall bear the direct costs of returning the goods.
You only have to pay for any diminished value of the goods if this loss of value is due to handling of the goods that is not necessary for checking their condition, properties, and functionality.

5. Prices
Price changes are reserved. In the event of a price increase, you as a customer are not bound to your order. All prices are stated inclusive of the statutory value-added tax (VAT).
6. Due Date and Payment, Default
The purchase price becomes due immediately upon ordering. The customer can pay the purchase price against invoice or by direct debit. If the customer defaults on payment, BBD Buy Best Europe GmbH is entitled to demand default interest at a rate of 5% p.a. above the base interest rate announced by the Deutsche Bundesbank. No liability can be assumed for the loss of cash or checks sent by mail.
7. Offsetting, Retention
The customer only has a right to offset if his counterclaims have been legally established or recognized by BBD Buy Best Europe GmbH. Furthermore, he is only authorized to exercise a right of retention to the extent that his counterclaim is based on the same contractual relationship.
8. Retention of Title
The delivered goods remain the property of BBD Buy Best Europe GmbH until full settlement of all claims existing against the customer.
9. Warranty for Defects and Liability
If there is a defect in the purchased item for which BBD Buy Best Europe GmbH is responsible, BBD Buy Best Europe GmbH is entitled, at its own discretion, to remedy the defect or to provide a replacement delivery. If BBD Buy Best Europe GmbH is not willing or able to remedy the defect/provide a replacement delivery, or if this is delayed beyond reasonable periods for reasons for which BBD Buy Best Europe GmbH is responsible, or if the rectification of defects/replacement delivery fails in any other way, the customer is entitled, at his choice, to withdraw from the contract or to demand a corresponding reduction in the purchase price.
Unless otherwise stated below, further claims of the customer – regardless of the legal grounds – are excluded. BBD Buy Best Europe GmbH is therefore not liable for damage that did not occur to the delivered item itself; in particular, BBD Buy Best Europe GmbH is not liable for lost profits or other financial losses of the customer. Insofar as the liability of BBD Buy Best Europe GmbH is excluded or limited, this also applies to the personal liability of employees, representatives, or vicarious agents.
The foregoing limitation of liability shall not apply if the cause of the damage is based on intent or gross negligence. Furthermore, it does not apply if the customer asserts claims based on §§ 1, 4 of the Product Liability Act (Produkthaftungsgesetz), claims due to the absence of an assured quality, or claims for damages due to non-performance in accordance with §§ 463, 480 para. 2 of the German Civil Code (BGB). The same applies to initial inability or justifiable impossibility.
If BBD Buy Best Europe GmbH negligently breaches a material contractual obligation, the obligation to pay compensation for property damage or personal injury is limited to the typically occurring damage.
The warranty period applies in accordance with the statutory regulation, calculated from the transfer of risk. This period is a limitation period and also applies to claims for compensation for consequential damages caused by defects, provided that no claims arising from tort are asserted.
10. Data Protection
BBD Buy Best Europe GmbH stores and processes your personal data in compliance with the applicable data protection regulations exclusively for the fulfillment of this contract. The data received from you (salutation, name, address, date of birth, e-mail address, telephone number, start and end of the connection to BBD Buy Best Europe GmbH) will be collected exclusively from you, processed on our server, and used insofar as they are required for the establishment, execution, amendment, or termination of this contract. BBD Buy Best Europe GmbH is entitled to transfer this data to partners commissioned with the execution of this contract, as far as this is necessary for BBD Buy Best Europe GmbH to fulfill its rights and obligations under this contract. This consent can be revoked by you at any time with effect for the future.
11. Final Provisions
The law of the Federal Republic of Germany shall apply. The place of performance and jurisdiction is Hamburg.
Should one or more clauses of this contract be or become invalid, the contracting parties undertake to agree on a legally valid clause that comes as close as possible to the economic intent, instead of the invalid clauses. The same shall apply in the event of a loophole that needs to be regulated. The legal validity of the remaining agreement shall not be affected by the invalidity of individual clauses.
